Tips for Landowners Wanting to Lease Land

In any land transaction, it is imperative to have an attorney who has experience in natural gas leasing to review your lease. 
   

Prior to meeting a landowner group or attorney specializing in natural gas, make a list of any items that you feel are important to you in a lease or any questions you may have about leasing and drilling.  This insures that all of your concerns are put on the table at the first meeting. Make sure all terms are addressed in writing in the lease.


There’s no such thing as a standard contract. 


Minerals and oil gas are separate in Pennsylvania.  Also leasing and selling rights are different.  Lease, don’t sell your rights. 

A good lease should preserve the surface, ensuring that the land will be restored as well as possible to its natural state.


Remember it is never a good time to sign a bad lease, but it is always a good time to sign a good lease. You can set your own time frame.  You don’t have to sign the lease immediately.  Take your time to review it.


There’s no reason you cannot talk to multiple companies and compare their offers.   You can also ask your neighbors who have signed leases to review their leases with you, if they are willing. Groups offer power in numbers allowing multiple company negotiations. 


Make sure all leases include mid-term and terminal reclamation, restoring property to its natural state. 


Limit gas companies to what they need, not want, therefore allowing additional income streams for further negotiation.   ie.  foreign pipelines - which refers to a pipeline that is not carrying gas from your property but across your property. 


Any extension of the primary term should be absolutely understood. 

Leases should contain language that has remedies for non-performance and non-payment from the drilling company. 

It is suggested that the landowner is notified in writing if the lease is assigned to another company. 


Good contracts require water be tested from every water source on your property for both quality and quantity by a third party. 


This can be life changing wealth and you should receive sound financial advice to serve your family’s long-term needs.


Get educated, research, and ask questions to become comfortable with the decision that can affect future generations!

From UNIVERSITY PARK, Pa. – “A series of Web-based seminars aimed at helping local businesses prosper from natural-gas drilling and development will be offered this fall by Penn State Extension's Marcellus Educational Consortium.

"Your Business and Marcellus Shale: Moving Forward 2011" is a five-part program intended to help local businesses understand and take advantage of the opportunities arising from development of the Marcellus Shale.

"Participants will expand their knowledge of the opportunities that exist in the market and learn how to make connections and plan for doing business in this growing industry," said Jonathan Laughner, extension educator in Beaver County who is moderating the sessions, one of which will be held every other week. Each webinar will feature speakers who are experts in the field.
 

"Our webinar speakers will include natural-gas industry representatives, local business people successfully responding to opportunities, financial specialists and business-development representatives," Laughner said. "Anyone interested in learning more about this aspect of the industry is welcome to attend."
